| Just as it did in public statements, Apple's taking a strong stance in its defense against alleged price-fixing actions in concert with major ebook publishers. In US District Court filing yesterday, Apple claimed that "the Government's Complaint against Apple is fundamentally flawed as a matter of fact and law," going on to say that "Apple has not 'conspired' with anyone, was not aware of any alleged 'conspiracy' by others, and never 'fixed prices.'" Apple even acusses the government of "[siding] with monopoly, rather than competition."All in all, it's quite the strenuous defense. Unsurprisingly, Apple claims its entry into the eBook... |
Should taxes take bigger bite of Apple?

| Unlike the government (and unlike the New York Times), we come to celebrate Apple, not to bury it. The Times' recent headline about the Cupertino-based computer company was, "How Apple Sidesteps Billions in Taxes." A couple of obvious conclusions may be drawn. Either, this is shameful. Or, this is admirable. You can read the Times story and draw your own conclusion about that paper's conclusion. You can find it here. However, there are a few tell-tale signs that tip the Times' hand. Here's one: . . . |

| Bill Whittle over at Pajamas Media had a great piece in his Afterburner segment this week. Calling statistician William M. Briggs The love of theory is the root of all evil The Best Sentence Ever, Whittle discusses how the love of the theory of Communism caused the deaths of well over 100,000 million people during the 20th century. The crux of his piece is that liberals, living in their world of theory and planning have no clue how the world actually works. Just such liberal fatuousness was on display in Saturdays New York Times. The paper ran a 3,800... |
Apple Could Offer Own Wireless Service, Observer Says (To bypass AT&T and Verizon Wireless)

| Apple (AAPL) soon might bypass AT&T (T) and Verizon Wireless, co-owned by Verizon Communications (T) and Vodafone (VOD), to offer its own mobile wireless service directly to customers, according to an industry observer. Veteran wireless industry strategist Whitey Bluestein made the bold prediction while speaking at the Informa MVNO Industry Summit in Barcelona, Spain, according to BGR. Apple has the distribution channels and customer base, with more than 250 million credit card numbers on file for iTunes users, to make the move, Bluestein said. But to do so, Apple itself would have to subsidize its iPhone for customers, Bluestein says.... |

| In one of those great ironies of technology, an increased incidence of malware is a sign that your product has been a success in the market. Apples been astonishingly successful with its Mac hardware in recent years. The dark side of that success is the attention theyve begun to attract from online criminals. Apple and its customers got a hint of what was in store with last years Mac Defender outbreak. This year, a much larger and more disturbing outbreak has infected more than 600,000 Macs with a piece of malware called Flashback. The entire Flashback episode has in fact exposed... |
Apple, the tax-dodger? We certainly hope so. You should too.

| The New York Times reported Apple paid cash taxes of $3.3 billion around the world on its reported profits of $34.2 billion last year, a tax rate of 9.8%. Further more, Apples federal tax bill likely would have been $2.4 billion higher last year without these moves, says the Times. The fact remains Apple paid less tax than it would have otherwise had it not moved operations to low- or no-tax jurisdictions. Good for Apple. Wouldnt it be wonderful if we all had the same flexibility? |

Mr Wozniak, who co-founded Apple with the late Steve Jobs in 1976, has given a shocking endorsement of Windows' 7.5 Mango interface. The 61-year-old, who no longer works full-time for Apple, says of the four phones he travels with (including two iPhones), the Nokia Lumia makes him feel as though he is 'with a friend, not a tool'. Samsung sold more smartphones in the first three months of the year than Apple and raked in more than 70% of its operating profit from mobile businesses. Shares in Samsung shot up nearly 3%. Net profit nearly doubled from a year earlier to a record 5.05 trillion won (£2.75bn) for the quarter to 31 March. Operating profit also hit a record high, at 5.85 trillion... |

(The Verge first picked up the interview). Overall, Wozniak says he prefers the look and feel of Windows Phone apps over Android and iPhone apps. RENO, Nev. Apple, the worlds most profitable technology company, doesnt design iPhones here. It doesnt run AppleCare customer service from this city. And it doesnt manufacture MacBooks or iPads anywhere nearby. Yet, with a handful of employees in a small office here in Reno, Apple has done something central to its corporate strategy: it has avoided millions of dollars in taxes in California and 20 other states. Apples headquarters are in Cupertino, Calif. By putting an office in Reno, just 200 miles away, to collect and invest the companys profits, Apple sidesteps state income taxes on some of those...
Carriers Desperately Seeking Windows Phone

| AT&T and Verizon Wireless want Windows Phone smartphones to succeed in the U.S., partly to provide leverage against Apple's demands for subsidies and other concessions required for selling the popular iPhone. AT&T recently began selling the Nokia Lumia 900 with the Windows Phone 7 operating system for a competitive $99.99 price. Meanwhile, Verizon Chief Financial Officer Fran Shammo recently told Reuters that Verizon is "really looking at the Windows Phone 8.0 platform because that's a differentiator." Both carriers need a strong competitor -- like Windows Phone -- to go up against the iPhone and Android phones, analysts said. The wireless... |

Apple generates more gossip than the Kardashians. There's a constantly spinning mill of rumors about Apple products, most of which turn out to be untrue. What's unusual this week is that talk has revived of a smaller iPad model, an idea company founder Steve Jobs derided publicly a year before he died. WHY IT'S A GOOD IDEA: A smaller tablet would help Apple further its lead in the tablet market. "From a competitive standpoint, we believe an iPad mini with a lower price point would be the competition's worst nightmare, says Shaw Wu, an analyst at Sterne Agee. "Most (competitors)...

| The DOJ's Mugging Of Apple Reminds Us That Antitrust Is TheftThe government should not interfere in any pricing or offering, even if a company outright colludes with competitors to set a price. Market participants have a right to offer their goods and services at whatever price they wish, and they should be free to determine that price however they wish. Some sort of twisted resentment at companies for deliberately trying to get the most money from a deal is not a valid basis for outlawing their activity. No one is forcing anyone to buy their products. Those who do not... |

| Apple has taken issue with the consumption estimates for its Maiden, N.C. data center included in a just-published "How Clean is Your Cloud?" report by Greenpeace, noting that renewable energy will provide 50 percent more of the center's power needs than the environmental advocacy group projected. Greenpeace on Tuesday gave Apple low marks in its new report and criticized it for its reliance on coal-based power. In the report, the organization dismissed Apple's renewable energy efforts for its Maiden, N.C., server farm as providing just 10 percent of "their total generation." The Cupertino, Calif., company quickly responded in a statement,... |

But it's not just people that are affected, but also the environment. Built to support iCloud, Apple's new billion-dollar data center in Maiden, North Carolina is another strike against the world's most valuable company. In fact, the behemoth, which is one of the largest such facilities on the planet, is powered mostly by coal, through Duke Energy. | Here we go again. Kaspersky Lab security researcher Costin Raiu has discovered another Mac OS X Trojan. Dubbed Backdoor.OSX.SabPub.a (or just SabPub, for short), the malware uses Java exploits to infect a Mac, connect to a remote Web site, and wait for instructions that include taking screenshots of the user's Mac and executing commands. "The Java exploits appear to be pretty standard, however, (and) they have been obfuscated using ZelixKlassMaster, a flexible and quite powerful Java obfuscator," Raiu wrote on the Securelist blog. "This was obviously done in order to avoid detection from anti-malware products." Related stories Raiu's discovery comes... |

| The U.S. filed an antitrust lawsuit against Apple Corp., Hachette SA, HarperCollins, Macmillan, Penguin and Simon & Schuster in New York district court, claiming collusion over eBook pricing. Apple and Macmillan, which have refused to engage in settlement talks with the Justice Department, deny they colluded to raise prices for digital books, according to people familiar with the matter. Flashback is a family of Mac OS malware that appeared in September 2011. Older Flashback versions relied on social engineering tricks to infect computers, but the latest variants are distributed via Java exploits that don't require user interaction.
